Procedures for Applying Building Approval

Registration can be done by applicants or building owners through the Building Management Information System (SIMBG) application at the website www.simbg.pu.go.id.

Government Regulation (PP) number 16 of 2021 is not just a derivative of the revision of Law (UU) number 28 of 2002 concerning Buildings by the government through Law number 11 of 2020 concerning Job Creation. This PP also contains the steps for arranging a Building Approval (PBG) which is regulated in more detail in Article 253.

Paragraph 1 of Article 253 states, the technical plan document is submitted to local governments of regencies, cities or provinces, such as DKI Jakarta or the central government, to obtain PBG prior to construction. Paragraph 2 explains that the technical plan document is submitted to the minister in the case of a Special Function Building (BGFK).

BGFK is a building which status has been determined as a cultural heritage in accordance with the provisions of laws on cultural heritage. PBG as referred to in Paragraph 1 is carried out to construct new buildings or infrastructure, change, expand, reduce, and or maintain buildings or building infrastructure.

Paragraph 5 states, PBG includes the planning and publishing consultation process. The technical plan document as referred to in Paragraph 1 will be examined and approved in the consultation process as referred to in Paragraph 5 Letter a. The consultation stages as mandated in Paragraph 7 include registration, inspection of compliance with technical standards and statement of compliance with technical standards.

Whereas in Paragraph 8 it is stated that the planning consultation as referred to in Paragraph 5 Letter a is free of charge. Registration is carried out by the applicant or owner through the Building Management Information System (SIMBG) application at the website www.simbg.pu.go.id. SIMBG is a web-based electronic system used to carry out the process of implementing PBG, Functional Feasibility Certificate (SLF), Certificate of Building Ownership (SBKBG), Building Technical Plan (RTB), and building data collection accompanied by information related to building operation.

Paragraph 10 states, applicants or registered owners must submit information in the form of applicant or owner data, building data, and technical plan documents. Meanwhile, Paragraph 12 states that the head of the technical office assigns the secretariat to check the completeness of the information as referred to in Paragraph 10.

Meanwhile, the minister assigns the central secretariat to check the completeness of the information for BGFK as in Paragraph 10. After the information as referred to in Paragraph 10 is declared complete, the secretariat provides a schedule for planning consultation to the applicant or owner via SIMBG as stated in Paragraph 14.
