The Ministry of Manpower together with the Ministry of Law and Human Rights have simplified the licensing for Foreign Workers (TKA) use. The simplification is done by cutting the implementation of Presidential Regulation Number 20 Year 2018. It contained the points of Minister of Manpower Regulation concerning Procedures for the Use of Foreign Workers (TKA) and Minister of Law and Human Rights Regulations concerning Procedures for Granting Visas and Residence Permits for foreign Workers.

The simplifying the rules has integrated the service system through a web-based technology application called TKA online. TKA online is a web-based information technology application to provide services to TKA employers through the tka-online.kemnaker.go.id web page. TKA online is also used to obtain a Plan for Using Foreign Workers (RPTKA) for TKA employers.

The licensing process for foreign workers utilization in 2019 can be done online at the tka-online.kemnaker.go.id web page. The process of RPTKA application goes through several stages including:

1. The applicant registers to get an online RPTKA queue
2. Fill in the RPTKA document form
3. Uploading the RPTKA documents
4. Ministry of Manpower verifies RPTKA and exposes scheduling.
5. Submission of RPTKA ratification for 2 working days since the completed requirement.
6. Valid RPTKA holder

To get the RPTKA, the TKA employer must submit an application to the Director General of Manpower Placement and Employment Expansion Development or the Director of Controlling the Use of Foreign Workers through an online system in two ways such as follows:

Fill some data below:

1. The identity of TKA employer;
2. Number of Indonesian workers employed;
3. Plans for the annual absorption of Indonesian workers;
4. Planning for foreign workers utilization for each year according to the work agreement;
5. Companion Workforce Data; and
6. Reasons for using TKA.

The applicant must also upload the following documents:

1. The draft of work agreement or employment agreement;
2. Chart of organizational structure;
3. Statement letter for Companion Workers assignment;
4. Statement to carry out education and job training for Indonesian workers in accordance with the qualifications of position occupied by TKA; and
5. An emergency and urgent statement from the TKA Employer in case that the TKA Employer assigns the TKA for emergency and urgent Work.

The flow of TKA user registration to get an account:

1. Submit an application for TKA online registration through the website tka-online.kemnaker.go.id by filling out the Taxpayer Identification Number (NPWP);
2. NPWP is automatically validated by the Online TKA (SIPPTKA) Service Information System;
3. TKA users complete the document data and upload data;
4. TKA user‘s E-mail is automatically validated by SIPPTKA;
5. TKA users open the verification link sent by SIPPTKA via e-mail;
6. Verifiers check all the data entry and application documents for TKA Users registration;
7. TKA users can use their account through the tka-online.kemnaker.go.id web page.

Chronology of making a New Foreign Worker Application (RPTKA) Draft:

1. Submit an application for assigning new foreign worker (RPTKA) online using an account that has been registered;
2. Verification of RPTKA data and telephone scheduling;
3. Conduct online conversation through video call;
4. Printing out the draft SK RPTKA;
5. Eligibility assessment of assigning foreign workers (TKA) by Head of Section;
6. Eligibility assessment of assigning foreign workers (TKA) by Head of Sub Directorate;
7. Ratification of SK RPTKA by the Director;
8. Foreign workers (TKA) employer is suggested to print RPTKA through company accounts.
